SAMPLE PROFESSIONAL ARBITRATION & MEDIATION, LLC ARBITRATION CLAUSE - GENERAL

In the event a dispute should arise under this contract, including but not limited to disputes over payment fees, malpractice claims, or defamation claims relating to representation, the Firm and Client agree to resolve the dispute by binding arbitration through Professional Arbitration and Mediation LLC (“PAM”). Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof, including but not limited to New York Supreme Court, County of New York. The parties waive any right to trial de novo and understand that the arbitration award is final. The parties expressly opt out of New York’s Part 137 mediation and arbitration program in favor of arbitration through PAM. A copy of PAM arbitration rules and schedule of fees can be found here.

The parties agree that this contract shall be considered formed in New York County, New York and that any disputes under it shall be decided according to New York law.
